§ 1.1. - These General Terms and Conditions (terms) apply to all contracts concluded via the website and the customer area of BoltLayer or via the application programming interface (API). Your contractual partner is BS Hosting UG (haftungsbeschränkt), Forsthauswinkel 6, 45891 Gelsenkirchen (hereinafter “BoltLayer”, “we” or “us”). BoltLayer is a brand of BS Hosting UG (haftungsbeschränkt). The version valid when the contract is concluded applies.
§ 1.2. - A consumer is any natural person who concludes a contract for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession when concluding the contract (§ 14 BGB). “Customer” covers both. Resellers are businesses that pass our services on to their own customers in their own name.
§ 1.3. - We offer in particular web hosting, servers (virtual servers, root servers, containers), voice and game servers, domains, SSL certificates, software licences, IP addresses, colocation, reselling and IT services. The content and scope of each service follow from the service description at the time of the order.
§ 1.4. - Deviating terms of businesses only apply if we expressly agree to them in writing. Individual agreements, such as individual prices or quotes, take precedence over these terms.
§ 1.5. - The contract language is German. We additionally provide the website, the customer area and these terms in English. The English version is for information only; in case of differences, the German version prevails.
§ 2.1. - A free customer account is required to order. Customer accounts are kept separately for each brand. There is no entitlement to opening a customer account.
§ 2.2. - When registering and in the profile, the customer provides true and complete information and keeps it up to date. Businesses state their company name and, if available, their VAT identification number. We verify VAT identification numbers from other EU member states via the European Commission’s VAT Information Exchange System (VIES).
§ 2.3. - Minors may use a customer account from the age of 14. Contracts of minors are only effective if their legal guardians consent or the service is paid for with means given to the minor for this purpose or for free disposal (§ 110 BGB). For minors, we may request the consent of the legal guardians and proof of age and hold back orders until then. Automatic renewals and automatic top-ups require the consent of the legal guardians for minors. Information for parents is available on our page Information for parents.
§ 2.4. - Login details, two-factor codes, recovery codes and API keys must be kept secret. If the customer becomes aware of misuse, they inform us without delay and change the affected credentials. Login is also possible via linked accounts of other providers (e.g. Google, GitHub, Facebook or Discord); their terms of use apply additionally.
§ 2.5. - We may block the customer account in whole or in part if the customer seriously violates legal provisions or these terms, in particular in the case of false information, misuse or payment fraud. In doing so, we take the customer’s legitimate interests into account and, where reasonable, announce the block in advance. Payment claims remain unaffected by a block.
§ 2.6. - Our team may log in to the customer account to provide support, to investigate errors or to set up products for the customer. Every such access is logged. Team accounts have no customer area of their own and cannot order products for themselves.
§ 3.1. - The customer can terminate their customer account at any time and request its deletion as soon as no products are running and no claims are outstanding. Running products end at the end of their term.
§ 3.2. - We may terminate the customer account with four weeks’ notice if no products are running. The right to extraordinary termination for good cause remains unaffected.
§ 3.3. - On request, we refund any paid-in balance not used at the time of termination to the original payment method or to an account named by the customer. Credits from vouchers, promotions and the partner programme are excluded and are not paid out.
§ 3.4. - After termination, we delete the personal data unless statutory retention obligations apply. We keep invoices and accounting records in accordance with tax and commercial law (usually eight to ten years).
§ 4.1. - For consumers, all prices are final prices including statutory VAT. For businesses and resellers, prices are exclusive of statutory VAT unless stated otherwise. For businesses from another EU member state with a valid VAT identification number confirmed via VIES, we invoice without VAT (reverse charge).
§ 4.2. - The customer account is kept in euros. Orders and renewals are usually paid from the balance of the customer account (prepaid). The customer tops up the balance using the offered payment methods. We do not issue a separate invoice for a top-up; the customer receives the invoice for the ordered or renewed service. On request, the customer can set up an automatic top-up and stop it at any time in the customer area.
§ 4.3. - The payment methods offered are shown on the Payment methods page and in the customer area. Depending on the brand, they include payments via Mollie (e.g. credit card and SEPA direct debit), Stripe, PayPal, cryptocurrencies via Cryptomus and bank transfer. The terms of the respective payment service provider also apply to the payment.
§ 4.4. - For SEPA direct debit, the customer grants a SEPA direct debit mandate. The pre-notification is given at least one day before the due date, usually with the invoice or order confirmation. If a direct debit or card payment is charged back for reasons the customer is responsible for, the customer reimburses the costs incurred (currently EUR 4.90 plus statutory VAT per chargeback); the customer may prove that no damage or less damage was incurred. We deduct the charged-back amount from the balance.
§ 4.5. - We issue invoices electronically and provide them in the customer area and by email. Consumers receive an invoice with gross amounts for each order and renewal. Businesses with a verified VAT identification number and resellers receive a collective invoice on the first day of each month for all orders, renewals and usage fees of the previous month, with net amounts and VAT shown separately. If a service ends before the start of a renewal period that has already been invoiced, we cancel the invoice for that period.
§ 4.6. - Resellers and businesses may receive a credit limit by separate agreement (postpaid). Within the credit limit, the balance may become negative; the negative amount becomes due with the collective invoice. Without an agreement, the balance cannot be overdrawn.
§ 4.7. - Invoices not already settled from the balance are due without deduction within 10 days of the invoice date, unless the invoice states otherwise. For larger orders we may offer payment in instalments; the instalments become due on the agreed dates.
§ 4.8. - If the customer does not pay an invoice when due, we send a reminder by email and then dunning notices. As a flat-rate compensation for dunning costs we charge consumers nothing for the payment reminder, EUR 2.50 for the first dunning notice, EUR 5.00 for the second dunning notice; businesses and resellers nothing for the payment reminder, EUR 5.00 for the first dunning notice, EUR 10.00 for the second dunning notice. The customer may prove that no damage or less damage was incurred. Statutory default interest and, towards businesses, the default lump sum under § 288 (5) BGB remain unaffected.
§ 4.9. - If an invoice is still unpaid 35 days after the due date and the customer has received at least one dunning notice announcing the suspension, we may suspend the affected products (right of retention, § 273 BGB). We lift the suspension without delay once payment is received. The obligation to pay continues during the suspension. In the case of considerable payment default, we may terminate the contract for good cause.
§ 4.10. - Vouchers and promotional codes can only be redeemed within their conditions (e.g. validity, number of redemptions, eligible products) and cannot be paid out in cash. A redemption only counts once the related order has been successful.
§ 4.11. - In the affiliate programme, customers receive a credit to their balance for new customers referred via their partner link; the amount is shown in the customer area. A registration bonus is only credited after the referred account has been confirmed. Self-referral, multiple accounts and other manipulation exclude the credit; we reverse credits received wrongly.
§ 4.12. - The price of a booked term remains unchanged for that term. We announce price changes for future renewals at least six weeks in advance by email; the customer can switch off automatic renewal until the end of the term.
§ 4.13. - Our support for booked products is free of charge. We provide services beyond this (e.g. setup, migration, troubleshooting of customer software) after prior agreement for a fee of EUR 18.75 per started 15 minutes (EUR 75.00 per hour), unless agreed otherwise.
§ 5.1. - Products are booked for the term selected when ordering. Without automatic renewal, the contract ends when the term expires, without the need for termination. The customer can extend a term before it ends; shortening is not possible. If the customer has activated automatic renewal, the product is extended by the selected term if there is sufficient balance (or credit limit) when it expires. The customer can switch off automatic renewal in the customer area at any time until the end of the term.
§ 5.2. - The presentation of products on the website is not a binding offer. By clicking the order button, the customer submits a binding offer. Before submitting, they can check and correct all details. The contract is concluded when the product is provided or when we send our order confirmation by email, whichever comes first. For orders via the API, the contract is concluded with the successful response of the API. If our team sets up a product at the customer’s request, the contract is concluded when it is provided. For the contract language see § 1.5.
§ 5.3. - We store the contract text. The customer can view the order data in the customer area; the current terms are on this page.
§ 5.4. - We provide most products automatically, usually within a few minutes. We usually provide manually set-up products within 48 hours. For domains and SSL certificates, provision also depends on the registry or certificate authority.
§ 5.5. - Products billed by the hour have no fixed term. They are charged from the balance for each started hour at the stated hourly rate, even if the product is stopped, but at most up to the monthly price of the product per calendar month. The customer can delete them at any time; billing then ends with the current hour. If the balance is insufficient, the product is suspended; for resellers, § 4.6 and § 4.9 apply instead.
§ 5.6. - When a product ends, we suspend it and delete it permanently, including all stored data, after a short grace period (currently 5 days, 7 days for products billed by the hour). The customer backs up their data in good time before the contract ends. Backups created by us are deleted together with the product.
§ 5.7. - Package changes: For many products, the customer can switch to another package in the customer area during the term. A switch to a larger package (upgrade) takes effect immediately; we charge the price difference for the remaining term pro rata to the day from the balance. A switch to a smaller package (downgrade) also takes effect immediately, without a refund for the current term; the lower price applies from the next renewal. For servers, storage can only be increased, and a switch is only possible if there is enough free capacity on the host. Products billed by the hour and software licences are excluded from package changes unless the customer area offers otherwise. If the change fails for technical reasons, we refund any amount already charged.
§ 5.8. - Termination: A product with a term is terminated ordinarily by the customer switching off automatic renewal in the customer area; the product then ends when the term expires. In addition, any customer can terminate contracts without logging in via the page Cancel contracts here (§ 312k BGB). We confirm receipt of the termination immediately by email with date and time and state when the contract ends. The right of both parties to extraordinary termination for good cause remains unaffected.
§ 6.1. - We provide our services according to the current state of the art. We strive to achieve the highest possible availability; we only owe a specific availability if it is expressly promised in the service description. Excluded are times when the service cannot be reached for reasons beyond our control (e.g. force majeure, disruptions of third-party networks, attacks despite appropriate protective measures) as well as announced maintenance.
§ 6.2. - Where possible, we carry out maintenance at off-peak times and announce it in advance, where possible, e.g. on our status page.
§ 6.3. - There is no entitlement to a specific IP address, hardware or location. We may change these if it is technically, legally or economically necessary and reasonable for the customer; we inform the customer in good time.
§ 6.4. - We may use third parties to provide the services, e.g. data centre operators, infrastructure partners, domain registrars, certificate authorities and licensors.
§ 6.5. - The customer receives support via tickets in the customer area, the contact form, by email and, where offered, by phone or on our Discord server. Response times stated in the customer area are targets, not guaranteed deadlines, unless agreed otherwise. We show the current state of our services on our status page.
§ 7.1. - The customer uses the services only within the law. Prohibited are in particular unlawful content, content harmful to minors or content infringing the rights of others, sending unsolicited advertising (spam), operating open mail relays or proxies for third parties, attacks on other systems (e.g. DDoS, port scans, brute force), phishing, distributing malware and crypto mining unless expressly permitted.
§ 7.2. - For products with administrator or root access, the customer alone is responsible for the configuration, updates and security of their system. They set up their product in such a way that the security and availability of our networks and of third-party systems are not endangered.
§ 7.3. - The customer regularly creates their own backups of their data outside the product, in particular before making changes. If we offer backups as a service, these do not replace the customer’s own backup unless agreed otherwise.
§ 7.4. - Unless agreed otherwise, data transfer volume is limited to 1,000 GB per month. If it is exceeded, we may throttle the connection to 3 Mbit/s until the end of the month. Email mailboxes are only intended for email traffic and not as general data storage.
§ 7.5. - The customer indemnifies us against third-party claims based on unlawful use of the services for which the customer is responsible, including reasonable costs of legal defence. We accept reports of abuse at abuse@bs-hosting.de.
§ 7.6. - If the customer processes personal data of third parties on our systems, they are the controller under data protection law. Businesses conclude a data processing agreement (DPA) with us for this, which they can sign digitally in the customer area under Settings → DPA.
§ 8.1. - We may suspend individual products in whole or in part if there is sufficient suspicion of unlawful content or a violation of § 7, if the product poses a danger to our systems or third parties (e.g. in the case of attacks or compromise) or if the conditions of § 4.9 are met. We choose the mildest suitable means and inform the customer, stating the reason; in the case of imminent danger, without delay after the suspension.
§ 8.2. - The suspension is lifted as soon as the reason no longer applies. In the case of serious or repeated violations, we may terminate the contract for good cause.
§ 8.3. - We accept notices of illegal content via the page Report content (Art. 16 of Regulation (EU) 2022/2065, Digital Services Act). We review every notice in a timely, diligent and objective manner. If we then remove or block content or products, we inform the affected customer of the reasons (Art. 17 DSA), unless a legal obligation or an order of an authority prevents this. The customer can object to the decision by ticket or email; we will then review it again.
§ 8.4. - We implement removal orders for terrorist content under Regulation (EU) 2021/784 within one hour of receipt. We inform the customer of this unless the authority prohibits it.
§ 9.1. - Web hosting: Web hosting packages share servers with other customers. If a package puts excessive load on the server (e.g. CPU, memory, storage, network) and affects other customers, we may throttle it after notice or, if notice cannot be awaited, suspend it temporarily.
§ 9.2. - Servers and containers: We operate virtual servers, root servers and containers on our own infrastructure or with infrastructure partners. The customer may only use the IP addresses assigned to them; other addresses are blocked technically. We provide additional IP addresses and subnets subject to availability. Assigned IP addresses remain our property or that of the responsible network operator and revert at the end of the contract. For subnets, we enter the data required under the rules of the RIPE NCC in the public RIPE database. A reinstallation via the customer area irrevocably deletes all data on the server. Additional IP addresses cannot be booked for servers billed by the hour.
§ 9.3. - Voice and game servers: For TeamSpeak servers and other software, the manufacturer’s licence terms also apply. The booked number of slots must not be exceeded.
§ 9.4. - Domains: For domains, we arrange the contract between the customer and the respective registry; we use registrars for this. The terms of the registry also apply (e.g. DENIC for .de). We do not guarantee that a domain will be assigned or that it is free of third-party rights. The customer ensures that the domain does not infringe the rights of others. The registrant data is transmitted to the registry and may be publicly accessible according to its rules. The domain is terminated at the expiry date if it is not renewed; a renewal cancels this termination. A transfer to another provider is possible at any time; the customer receives the auth code in the customer area or on request. If the customer gives no instruction at the end of the contract, we may return the domain to the registry after a reasonable period.
§ 9.5. - SSL certificates: Certificates are issued by the respective certificate authority, which checks the customer’s details according to its rules. Its terms also apply. Once issued, a return is excluded unless a statutory right of withdrawal exists.
§ 9.6. - Licences: If we provide software licences (e.g. Plesk, TekBASE), the customer receives a simple, non-transferable right of use for the term of the contract. The manufacturer’s licence terms also apply.
§ 9.7. - Resellers and API: Resellers pass on our services in their own name and for their own account and are solely responsible towards their customers; they oblige their customers to at least the obligations under § 7. The customer creates API keys in the customer area; they are responsible for all orders and actions triggered with their keys. We may limit the number of requests. We announce changes to the API that affect existing integrations with reasonable notice; the documentation is on the developer page. API keys can be restricted to specific IP addresses. In test mode (sandbox), orders and actions are only simulated; no contracts are concluded and no costs arise. If the customer sets up webhooks, we send events about their products to the address they provide; the customer is responsible for this address and the further processing of the data.
§ 9.8. - IT services and orders: For services such as setup, development, consulting or on-site service, the customer creates an order in the customer area. We give them a price or a price estimate; the contract is concluded when the customer accepts it. We invoice ongoing services at the agreed interval. If the customer area offers payment in instalments, the instalments become due on the confirmed dates; if the customer defaults on an instalment, § 4.8 and § 4.9 apply accordingly.
§ 9.9. - Cooperation partners: In our partner programme for projects and communities, approved partners receive their own discount depending on their level and can create discount or credit codes for their community. Partners appear with their name, logo and texts on our partner page; the partner is responsible for this information and the rights to logos. Codes must not be distributed on voucher or bargain sites. We may end the partnership with two weeks’ notice, or immediately in the case of violations; codes already redeemed remain valid.
§ 9.10. - Dedicated servers: We provide dedicated servers via infrastructure partners. They are set up manually after the order and, depending on hardware availability, may take longer than virtual servers; we inform the customer of the expected date. If the ordered model is not available, we refund amounts already paid to the balance.
§ 10.1. - Consumers have a statutory right of withdrawal as set out in the withdrawal policy. Businesses have no right of withdrawal. The consumer can also declare the withdrawal via our withdrawal function at Withdraw from a contract; we confirm receipt immediately by email.
§ 10.2. - If the consumer wishes us to start the service before the withdrawal period expires (e.g. with automatic setup), they expressly confirm this when ordering. The right of withdrawal expires as set out in the withdrawal policy once we have fully provided the service; otherwise, in the event of withdrawal, the consumer owes compensation for the services provided until then.
§ 11.1. - We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of a guarantee we have given.
§ 11.2. - In the case of slightly negligent breach of an essential contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the customer may regularly rely, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.
§ 11.3. - Within the scope of § 11.2, we are only liable for the loss of data in the amount of the effort that would have been required for restoration if the customer had properly backed up their data (§ 7.3).
§ 11.4. - The limitations of liability also apply in favour of our employees and vicarious agents. Strict liability for defects existing at the time of conclusion of a rental contract (§ 536a (1) BGB) is excluded unless § 11.1 applies.
§ 12.1. - How we process personal data is described in our privacy policy. For data that the customer processes on our systems, § 7.6 applies.
§ 13.1. - We may change these terms with effect for the future if there is a valid reason, such as changes in law, case law or new services. We announce changes by email and in the customer area at least six weeks before they take effect, together with a summary. For existing contracts, the changed terms only apply if the customer expressly agrees to them in the customer area; silence does not count as consent; however, if the customer is a business (§ 14 BGB), their consent is deemed given if they neither agree nor object by the effective date. If the customer declines, the previous terms continue to apply to them, and their contracts end at the end of the current term without being renewed. We point out this consequence in the notification. We do not use this procedure to change the main obligations or the prices of running terms.
§ 14.1. - The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.
§ 14.2. - If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our registered office (Gelsenkirchen).
§ 14.3. - We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 14.4. - Should individual provisions of these terms be invalid, the rest of the contract remains valid. The statutory provisions take the place of the invalid provision.
